- Regardless of whether an employee receives their wages through a salary, hourly rate, draw, production/piece rate, or commissions the Fair Labor Standards Act (FLSA) requires, in certain cases, that covered employers pay overtime wages every hour worked over forty (40) hours per work week and over eight hours (8) a day under California Law.
